The Team Lead for Against Cases operates in a highly sensitive and risk-critical environment, managing legal matters where the organization is a defendant or respondent. These cases often involve civil, criminal, consumer, and regulatory forums, requiring precise and timely responses to safeguard the company’s reputation and financial interests. The role demands strong coordination with external counsel, courts, and internal stakeholders to ensure compliance, minimize exposure, and maintain audit readiness. Success depends on proactive risk identification, strategic case handling, and accurate MIS reporting under strict timelines. - 1. High Sensitivity & Risk Exposure - Cases filed against the company can lead to reputational damage, financial penalties, or regulatory scrutiny. - Requires meticulous handling and zero tolerance for procedural lapses. - 2. Time-Critical Responses - Strict deadlines for filing replies, affidavits, and evidence to avoid adverse orders. - Managing multiple cases simultaneously under aggressive timelines. - 3. Complex Legal Forums - Navigating diverse forums (civil, criminal, consumer, regulatory) with varying procedures and documentation requirements. - Handling jurisdictional complexities and frequent cause-list changes. - 4. Evidence & Documentation Challenges - Gathering complete and admissible documentation from multiple internal sources. - Maintaining chain-of-custody and audit-ready records. - 5. External Counsel Management - Ensuring quality representation and timely filings while controlling costs. - Addressing last-minute adjournments and inconsistent counsel performance. - 6. Stakeholder Coordination - Aligning with internal teams (Business, Risk, Compliance) for case inputs and approvals. - Managing expectation mismatches between legal risk mitigation and business priorities. - 7. Compliance & Audit Pressure - Maintaining zero lapses in process adherence and documentation standards. - Closing audit observations promptly while sustaining operational throughput. - 8. Data Accuracy & MIS Integrity - Keeping case status updated in real time for governance and decision-making. - Reconciling discrepancies between counsel updates, court orders, and internal systems. - 9. Cost Optimization - Operating within tight budgets for legal fees, travel, and documentation. - Balancing cost efficiency with quality outcomes. - Key Result Areas: Write the key results expected from the job and the supporting actions for each of these key result areas (For a majority of jobs typically there could be 4- 7 key result areas) **Key Result Areas** Supporting Actions Legal Services - Provides litigation service to Departments to facilitate the achievement of business objectives - Act as a performer on all litigation issues for the Institution businesses. - Conduct research, vetting of opinions, critically examine/evaluate issues at hand - Provide support to central functions, including HR, IT, Admin, Marketing, and Customer Service on legal disputes, lawsuits, and potential legal concerns. Litigation Management -Develop and execute strategy towards achieving favorable outcomes in legal matters - Strategize case-handling approach and tactics - Draft customer notices for recovery, lapses, defaults, and covenant breaches - Respond to notices from customers, statutory authorities, and regulatory bodies (RBI, ED, EOW, SEBI, Income Tax, Police, etc.) - File section 138 cases, draft notices (dunning, statutory notice), file complaints, facilitate evidence, and attend hearings - Manage security enforcement for mortgages, pledges, etc. - Defend lawsuits filed against company - Appoint and brief counsel/law firms Process and Policy – Design and develop policies and guidelines; Ensure process efficiencies in litigation function - Ensure to Prepare proper and correct litigation MIS and share with Litigation head (Institutional) for review - Ensure compliance to policies and guidelines for litigation management - Aiding in SOPs to ensure the same are in place for all litigation activities People Management and Expertise Development - Conduct regular performance reviews and provide feedback - Motivate the team and ensure retention of employees - Guide the stakeholders through legal requirements. - Ensure development of robust knowledge management processes for Litigation - Reduce dependence on external counsel by developing in-house litigation expertise
