ROLEPURPOSE OBJECTIVE 1. Proactivelyengage in reduction of NPA, lessening litigation and enhancingrecovery. 2. Coordinatewith Credit Collections Team in managing collections and recoverythrough legal means. 3. Assistin invoking the provisions under SARFAESI Act in time, includingtaking possession (symbolic/physical), sale of secured assets andmonitoring the cases across Region 4. DraftingLegal Notice/Recall Notice, Notice under Section 138 ofNegotiable Instruments Act, Reply Notices/Rejoinders,Versions/Objections etc. 5. Apprisethe Regional Legal Manager about the progress in recovery throughlitigation and management of litigation portfolio of the Bank 6. Drafting/vetting/reviewof all kinds of credit documentation for MSE and Housing,including security documents and all transaction documents forvarious kinds of fund based and non-fund based as well as securedand unsecured facilities. 7. Toprepare/vet MoDT for registration. 8. Torepresent bank before SRO while registration and cancellation ofmortgage documents. 9. Torepresent bank before SRO during purchase cases and collect OTCdocuments. 10. Tocollect documents from other financial institutions on behalf ofbank in BT cases. 11. Vettingof Title Scrutiny Reports (TSR) submitted by panel Advocates toconfirm that the TSR satisfies the business requirements of theBank. 12. Assistthe business/Credit in registering Mortgages wherever necessary. 13. Managinglegal issues pertaining to creation/registration of Mortgages,Hypothecation, Pledge etc. 14. Ensureprompt handling of cases by panel Advocates. 15. Liaisewith Courts, Commercial Courts, Arbitration Tribunals, DRTs,Legal Services Authorities, panel Advocates, empaneled RecoveryAgents, Consumer Fora etc. and ensure their good relationshipwith the Bank SIZEOF THE ROLE FINANCIALSIZE NON-FINANCIALSIZE - N.A. - Recoverytarget of approx. 15 Cr. in secured vertical and unsecuredvertical together - Vettingof all Agreements and notices received in the cluster. KEYDUTIES RESPONSIBILITIES OF THE ROLE **Business:** 1. Monitoringand effectively support the Regional Legal Team in regard tocollections and deploy legal tools for the same. 2. Suggestingmeasures for enhancement of recovery and reduction of NPA for theRegion. 3. Toensure proper execution of loan and security documents at thetime of lending by the business and credit teams. 4. Toensure legal reports are furnished on time by external counsels. 5. Toco-ordinate with HUB officers on a regular basis. 6. Takingproactive measures in all litigation matters, to ensure earliestclosure as also to bring the opponents for negotiating table.Monitoring timey filing of S. 14 Application, Complaints under S.138 NI Act and recovery applications ad Suits before appropriateauthorities, Tribunal and Court of Law. **Customer:** 1. Assistthe respective regional legal teams in end to end management ofadvisory on lending related security creation and documentationas well as collection and other litigation. 2. Communicate/interactwith Regulators, Statutory Authorities, District Magistrates,First Class magistrates, consumer courts, Law enforcementAgencies, for resolution of legal issues/ensuring compliance. 3. Assistand co-ordinate with Collections team at regional/ cluster levelin executing tasks under SARFAESI, S. 138 NI Act and othermiscellaneous litigation. 4. Supportthe secured lending departments during loan documentation andsecurity creation. 5. Co-ordinatewith the Advocates and Enforcement Agencies in extending supportto Authorised Officers/ Signatories under SARFAESI, NI Act andother relevant provisions of law. **InternalProcess:** **Location -** Korha,Nagar,Kamrup,Durgapur,Purba Champaran,Kolkata
